Tariff concession from Korea will cover 99.7% of goods trade (with immediate effect for 80.4%) and from the US 100% (immediate effct for 82.1%)

ROK agrees to address specific auto non-traiff barriers. Reciprocal duty-free access form most textile and clothing goods.
Rules of Origin

The FTA adopts the "yarn forward" rule.

Nearly 95 per cent of bilateral trade in consumer and industrial products becomes duty-free within three years of entry into force of the Agreement.The reminder will be phased out over three to 15 years.           ARTICLE 11.11: DENIAL OF BENEFITS 1. A Party may deny the benefits of this Chapter to an investor of the other Party that is an enterprise of such other Party and to investments of that investor if persons of a non-Party own or control the enterprise and the denying Party: ... 2. A Party may deny the benefits of this Chapter to an investor of the other Party that is an enterprise of such other Party and to investments of that investor if the enterprise has no substantial business activities in the territory of the other Party and persons of a non-Party, or of the denying Party, own or control the enterprise. If, before denying the benefits of this Chapter, the denying Party knows that the enterprise has no substantial business activities in the territory of the other Party and that persons of a non-Party, or of the denying Party, own or control the enterprise, the denying Party shall, to the extent practicable, notify the other Party before denying the benefits. If the denying Party provides such notice, it shall consult with the other Party at the other Party’s request.
