Article 1: The National Committee for Population and Family
Planning (NCPFP) is a directly subordinate organ of the Government which has the
function of state management on population and family planning and coordinates
with line ministries, other subordinate organs of the Government and mass
organization to carry out population and family planning programme throughout
the country.
Article 2: The NCPFP has the following and responsibilities
and jurisdictions:

Work out strategies, plans, programmes, projects on
population-planning to submit to the government for approval and monitor the
implementation of the above-mentioned plans throughout the country.

Coordinate with concerned institutions to work out laws,
decrees, policies and under-law documents relating to population and family
planning to submit to the government for approval.
Issue by its jurisdiction decisions, circulars, instructions
on monitoring and guiding the implementation of the State regulations, programme
and projects management, relating to population and family planning; coordinate
with line ministries and other subordinate organs of the Government to define
regimes, standards, technical-economic norms and regulations on population and
family planning; participate in setting up policies relating to population and
family planning.

Arrange coordination among line ministries and mass
organizations to provide family planning information and services to people;
work out regulations for implementation of State policies and guidelines on
population and family planning for individuals and units.

Coordinate with the Ministry of Finance, the State Planning
Committee to submit financial plans to the Government to ensure implementation
of population and family planning programme.
After approved by the Government, the NCPFP is assigned to
follow up, monitor and manage such plans in accordance with the government
stipulations.

Give instructions and supervisions to line ministries,
mass organizations and provinces in implementation of State laws and regulations
on population and family planning.
Coordinate with institutional members of the Committee to
conduct specialized inspection on population and family planning, dealing with
petitions from citizens, creating favourable conditions for association, NGOs
for their involvement in population and family planning activities.

Submit to the Government issues relating to joining
international organizations, signing and approval of international conventions
on population and family planning; monitor and conduct the implementation of
international cooperation plans and conventions in accordance with government
stipulations.
Be involved in or proceed negotiation with international
organizations, foreign counterparts on population and family planning subject to
the Premier's authorization.
Follow up, monitor and coordinate the implementation of
international cooperation projects and programmes on population and family
planning (including assistance of governments and NG0s).

Govern population personnel and organizational system and
provide them technical training in accordance with the stipulation of the
Government; issue decisions relating to recruitment, rewards and discipline,
retirement and other State regimes to personnel under direct control of the
NCPFP.
Coordinate with concerned agencies to provide management
skills on population and family planning to leaders and staff who are involved
in population and family planning programme implementation.

Organize and conduct research plans as well as apply
scientific - technical progress to population and family planning.

Conduct collection, processing, storing and dissemination
of population and family information to meet the requirement of management, coordination
and implementation of population and family planning.

Coordinate with concerned agencies to examine conditions
for productions and import-export of family planning equipment and
contraceptives.
Article 3: The structure of the NCPFP includes:
- Chairman
- A full - time vice-chairman
- Coordinating vice - chairmen are leaders of the State
Planning Committee, the Ministry of Finance, the Ministry of Health.
The coordinating members of the NCPFP are leaders of the
Ministry of Labour, War invalids and Social Affairs; the Ministry of Culture and
Information; the Ministry of Education and Training; the Ministry of Defence;
the Ministry of Interior; the Ministry of Justice; the Committee for the
protection and care for children; the General Statistics Office; the Fatherland
Front of Vietnam; The Confederation of Vietnam Trade Union; the Vietnam Family
Planning Association, Ho Chi Minh Communist Youth Union, the Vietnam Women's
Union, the Vietnam Peasants' Union, the Vietnam War veterans and the Vietnam Red
Cross Society.
The Chairman and the full-time vice-Chairmen are appointed
and sacked by the Premier, the coordinating vice-Chairmen and members are
appointed by their own institutions as mentioned above.
Article 4: Obligations and jurisdictions of the NCPFP
members.
1. Obligations of the Chairman:
- Govern the administration of all activities of the NCPFP.
- Prepare contents, programmes, projects, policies, other
documents for discussions in the NCPFP before submitting to the government or
the premier for approval, or make decisions of matters authorized by the
Government; organize coordination between members of the, NCPFP, monitor and
supervise the implementation of population programme.
- Settle all problems relating to obligations and
jurisdictions of the NCPFP.
2. Obligations of the full-time vice-chairman:
Assist the Chairman, in charge of some aspects of activities
and on behalf of the chairman to deal with problems assigned by the chairmen.
3. Obligations of coordinating vice-chairmen and members.
- Fully participate in and be involve in discussions and
decisions making of the NCPFP
- Being responsible for management and monitoring their own
institutions to carry out the implementation of population and family planning
accordingly.
Article 5: Obligations of line ministries and mass
organizations of the NCPFP:

The State Planning Committee, in collaboration with the
NCPFP, is responsible for development and adjustment of annual and 5 year plans
to submit to the Government for approval.

The Ministry of Finance, in collaboration with the NCPFP
is responsible for defining and monitoring financial plans, financial
distribution mechanism, usage of approved resources for population and family
planning.

The Ministry of Health is responsible for providing and
monitoring the implementation of clinical family planning services, integrating
population and family planning to other programmes within the MOH, particularly
the maternal and child health care, developing technical aspects on family
planning, training technical cadres for family planning service, fostering
counselling skills on family planning for health workers, setting up a network
of clinical family planning services at communal level, conducting state
management to private sector.

The Ministry of Education and Training is responsible for
developing and implementing population and sex education for students of general
education, high school, university, vocational training and other types of
education, being involved in IEC activities on population and family planning
among students and pupils.

The Ministry of Culture and Information is responsible for
plan development and involved in motivation of people to practice family
planning through mass media and other education forms, providing cadres,
equipment, documents on population and family planning for those who are
involved in this work.

The Ministry of Defence and Interior are responsible for
educating and motivating armed forces to practice family planning, at the same
time, providing family planning services to cadres, soldiers and people in their
areas, particularly the remote places; introducing population and family
planning contents to formal training curriculum of specialized schools run by
the Ministries.

The Ministry of Labour, War invalids and Social Affairs is
responsible for developing and monitoring policies relating to implementation of
population and family planning.

The Committee for protection and care of Children is
responsible for integrating programme of protection and care of children to
population and family planning programme.

The General Statistics Office is responsible for
collecting, processing and providing timely and accurately information on
population and family planning as well as other socio-economic aspects relating
to the programme.

The Ministry of Justice is responsible for conducting
registration of birth, death, marriage according to its function.
-
Mass organizations are responsible for educating and
motivating their members on family planning practice in accordance with
guidelines of the NCPFP, making regulations on population and family planning
practice among mass organization; developing and multiplying advanced models to
encourage strong mass movements for acceptance of a small-size family, fostering
a network of family planning motivators.
Article 6: The organization of the NCPFP full-time staff
include:
- Administrative Bureau,
- Dept. of Planning-Finance and Policy
- Dept. of IEC
- Dept. of Family Planning Service Coordination
- Dept. of Organization, Personnel and Training
- Dept. of International Cooperation
- Inspection
- Centre for Population Studies and Information
Obligations, powers and staff of the said units are
stipulated by the Chairman of the NCPFP.
Article 7: The mechanism of population and family planning at
various levels is organized as follows:

Population and family planning steering committees are set
up within the line ministries and mass organizations and there are full-time
staff working as consultants for these committees.

Population and family planning committees are set up at
provincial and districts levels. The components of the population and family
planning committees are decided by the chairman of People's committee in
accordance with the guidelines of the NCPFP.
Functions, obligations, powers, organization and staff of
permanent office of population are decided by the people's provincial committee
in accordance with guidelines provided by the NCPFP and Personnel Organization
Dept. of the Government.

Population and Family planning units are set up at
communal level which include active components of population and family planning
headed by a chairman of people's committee of commune.
A full time cadre (not in a pay roll) is needed to assist the
head of communal. population and family planning unit.
Collaborators on family planning motivation and service are
available at population spots who directly manage family planning target
audience.

Population and family planning activities at factories and
establishments are run by a directing board who decides contents and assigns a
leader to be in charge with assistance of a specialized unit.
Article 8: This decree replaces decree No. 193- HDBT dated 19
June 1991 of the Council of Minister on the functions, obligations,
jurisdictions, mechanism and working relations of the NCPFP, and it becomes
effective from issuing date , all other stipulations which contradicts to this
decree are rescinded.
Article 9: The Minister, Chairman of the NCPFP, all
ministers, heads of Government Ministries, Chairmen of the People's provincial
Committees are responsible for executing this decree.
