Article 1:
The National Committee for Population and Family
Planning (hereinafter called NCPFP in brief) is a directly subordinate organ of
the Council of Ministers which has the function of coordinating the activities
of all branches and mass organizations concerned at various levels in order to
materialize the State's objectives, regulations and policies on population and
family Planning.
The components of the NCPFP include:
- One vice-chairman of the Council of Ministers acting as
Chairman of the NCPFP.
- One standing vice-chairman.
- The coordinating vice-chairmen.
The State Planning Committee, The Ministry of Health, The
Ministry of Finance each appoints a vice-minister or an equivalent official to
act as coordinating vice-chairman of the NCPFP.
The institutional members of the
NCPFP:
The Ministry of Labour, War Invalids and Social Affaires; The
Ministry of Culture, Information, Sports and Tourism; The Ministry of Education
and Training; The General Statistics Office; The Confederation of Trade Union;
The Youth Union's Central Committee; The Women Union's Central Committee; the
Central Committee of the Peasants’ Association, each appoints a vice-minister
or an equivalent official to act as a coordinating member of the NCPFP.
The NCPFP has its own seal and budget.
The NCPFP's staff is nominated by its Chairman.
Article 2 :
THE NCPFP HAS THE FOLLOWING OBLIGATIONS AND
RIGHTS

Mapping out the strategic guidelines, the annual as well
as 5 year plans, the regulations and policies on population and family planning
to be presented to the Council of Ministers for approval. Acting as the main
coordinator of and giving guidelines to all branches and people's committees at
various levels in mapping out and conducting the implementation of the
above-mentioned plans.

Acting in collaboration with the State Planning Committee
in balancing the population and family planning schemes with the national
socio-economic development plans.

The NCPFP is authorized by the Council of Ministers to
work out proposals to various international institutions and foreign countries
regarding the cooperation and aids for the population and family planning
programme, and together with the State Planning Committee in making allocations,
giving instructions and monitoring the utilization of such assistance for
population activities in the most effective way.

Monitoring and inspecting various branches, People's
Committee and mass organizations in education and implementation of plan and
policies on population and family planning.
-
Acting in collaboration with the Ministry of Finance
ensuring the allocation, distribution and utilization of budget, capital
investment equipment and materials in service of the population and family
planning programme.

Coordinating with the branches concerned in integrating
the population and family planning programme with their sectoral plans on the
basis of the guidelines proposed by the NCPFP and approved by the Council of
Ministers, in organizing the collection of statistical data on population and
family planning.

Carrying out the budgeting, management, coordination and
utilization of all resources (including foreign aids) for achieving the
objectives, plans, programmes and activities on population and family planning.

Conducting the monitoring and evaluations (by itself or in
coordination with the branches and organizations concerned) of the results of
the implementation of the population and family planning programme.

Requesting the branches and mass organizations concerned
at various levels to supply information on population and family planning.
Article 3 :
THE NCPFP DISCHARGES IT OBLIGATIONS AND RIGHTS
THROUGH THE ACTIVITIES OF THE WHOLE COMMITTEE, OF EACH COMMITTEE MEMBER OR OF
ITS STANDING BOARD IN A CONSENSUS MANNER.
A. Important issues concerning the obligations and rights of
the NCPFP which is under its mandatory consideration are as follows:
- Mapping out the strategic guidelines, the annual as well as
5 year plans; drafting out the population and family planning policies to be
presented to and approved by the Council of Ministers; making discussions in
order to finding out ways to materialise the guidelines, strategies, plans and
policies put forth by the government (this also includes the assignment of
obligations and responsibilities to each NCPFP institutional member).
- On the basis of the State budget, allocated for the
NCPFP,
the NCPFP in its turn makes the distribution of such budget to population and
family planning programme (including foreign aids) after the NCPFP's budget
distribution proposal had been approved by the Council of Ministers.
- Making decision on the inspection and evaluation of the
implementation of the population and family planning programmes and plans. On
the foundation of its reports (presented to the Council of Ministers or
delivered the branches concerned) evaluating the results of the implementation
of the population and family planning programmes and plans.
- Working out the NCPFP agenda and reviewing their
implementation.
The NCPFP will hold it regular meetings for every three
months, whenever it deems, necessary the NCPFP chairman will convene irregular
meetings.
During the meetings, the NCPFP will discuss and resolve all
the matters on the principle of consensus. In case there are differences of
views, final decisions will be made by the NCPFP Chairman.
The NCPFP chairman bears full responsibility to the Council
of Ministers and to the chairman of the Council of Ministers for all the
activities of the NCPFP, for the coordination among its members as well as those
between the NCPFP and the branches, organizations concerned at various levels
while discharging its functions.
B. Obligations of the NCPFP's coordinating vice-chairmen and
members
- Attending all the NCPFP meetings.
- Bearing full responsibility to the NCPFP in making
consideration on population and family planning issues within the coverage of
their respective branches as well as the obligations assigned to them by the
NCPFP.
- Organizing, controlling and directing their respective
branches in the implementation of the population and family planning works
assigned to them (as specified in Article 4 below); directing the designing of
their branches' plans and programmes of actions. Coordinating with the NCPFP
in defending their drafting plans and programmes when they are presented to
the Council of Ministers as well as in implementing them after they had been
approved by the Council of Ministers.
- Submitting all the official opinions of their branches to
the NCPFP on the matters concerning, the population and family planning
programme for discussions and decisions.
C. The Standing Vice-chairman is responsible to the NCPFP for
the following:
- Directing and controlling the full-time staff of the
NCPFP.
- Conducting the preparation work of the proposed issues to
be submitted to the NCPFP for discussions and approvals; organizing the
collaboration among the branches concerned at various levels, monitoring and
checking their implementation of the issues and matters which were decided by
the NCPFP and approved by the Government.
- Tackling the day-to-day activities of the
NCPFP; the works
within the obligations and rights of the NCPFP, except those mandated to the
NCPFP Chairman or those must be decided by all the NCPFP members as mentioned
above.
Article 4:
OBLIGATIONS AND RIGHT OF THE NCPFP MEMBER BRANCHES
AND OTHER PARTIES CONCERNED

The State Planning Committee (The
SPC) is responsible for
the cooperation with the NCPFP in working out, generalizing and balancing the
annual as well as 5 year plans for population and family planning to be
submitted at the same time with the socio-economic development plans to the
Council of Ministers for approval. The SPC coordinates with the NCPFP in mapping
out the population polices in distributing and supervising the utilization of
domestic funds as well as foreign aids, in implementing the population plans
already approved by the. Council of Ministers.

The Ministry of Finance is responsible for coordination
with the NCPFP in arranging and calling for funds from the various sources such
as: The State budget, local budgets, people’s contributions and aids from
international institutions, in defining the distribution and utilization
mechanism, inspecting the utilization of financial resources reserved for
population and family' planning programme.

The Ministry of Health (MOH) is responsible for mother and
child's health care; organizing and maintaining regular operations of
inter-communal family planning centers; setting the technical norms regarding
contraceptives as well as MCH methods and services; defining the category of
imported products for the population and family planning programmes; maintaining
the technical services with a view to fully supplying to users throughout the
country the contraceptive devices of increasingly-raised quality thus
drastically reducing the fertility rate; conducting campaigns to introduce
scientific ways of baby carrying; laying out the data collecting network and
periodically making public the MOH's achievements in the field of Mother and
Child’s health care; making suggestions on the settlement of issues within the
control of MOH concerning the population and family planning programme.

The Ministry of Education and Training (MET) is
responsible for the introduction of population and family planning education
programme into all of' its schools and colleges; embarking upon the education
programme for parents whose children are among the 3-5 year old group with a
view to supplying them necessary knowledge in child caring. The MET must become
an education center in the mobilization of the whole community to take part in
the population and family planning activities.

The Ministry of Culture-Information-Sports and Tourism is
responsible for carrying out the Information-Education-Communication programmes
in line with the general programme for population and family planning; giving
guidelines to and coordinating with mass media organizations at the various
levels nationwide (The Vietnamese Broadcasting and T.V station, the various
newspapers and publications... ) in order to enabling the full access of each
individual as well as family to the population and family planning information
thus readjusting their perceptions in conformity with the national tradition and
modern civilization.
The IEC activities must aim at making people fully aware of
the benefits gained to themselves and the whole society once they accept the
small-sized family model and carry out population and family planning programme.

The Ministry of Labour, War Invalids and Social Affairs is
responsible, for mapping out policies and means to properly utilize the manpower
resources; building the migrant mechanism and policy; monitoring and inspecting
the implementation of migrant projects so as successfully carry out the
population and family planing programmes.

The General Statistics Office
(GSO) is responsible for
building a network of information statistics with a view to correctly reflect
the population dynamics and development, the socio-economic indicators relating
to population development; collecting, processing and supplying those
information to the NCPFP's member ministries and branches thus making
contribution to the evaluation of results of the population and family planning
plans and programmes. At the same time, the GSO data also serve as a foundation
for mapping out future population plans and programmes.

The various mass organizations and public institutions
must positively coordinate with the NCPFP in designing their own action
programmes gearing at making positive contribution to materializing the
population and family planning’s objectives; mobilize their members to
voluntarily involve in the population and family planning campaigns and persuade
others to do so. Subject to their specific characteristics and obligation they
will define the appropriate contents, scopes and objectives for their programmes.

The Ministry of Defense and The Interior Ministry are
responsible for conducting education campaigns to the soldiers, officers and
policemen about population and family planning in order to ensuring that they be
good acceptors and educators of the population and family planning programme
during their service term as well as when demobilized.

The Ministry of Foreign Affairs is responsible for timely
informing and suggesting to the NCPFP information on potentials of international
assistance and cooperation in the field of population and family planning.
Together with the NCPFP in supervising and evaluating the cooperation with
international organizations in population and family planning programmes.
Article 5:
THE MECHANISM OF POPULATION AND FAMILY PLANNING IN
THE CONCERNED MINISTRIES, MASS ORGANIZATIONS AND PUBLIC INSTITUTIONS

In those ministries which are much engaged in activities
relating to population works such as : The Ministry of Health, The Ministry of
Education and Training, The State Planning Committee, The Ministry of
Culture-Information-Sports and Tourism and other mass media organizations there
must be a specialized section comprising of competent and full-time cadres who
will be consultants to their respective ministries on population and family
Planning issues. In other ministries and general departments, there will be
concurrently assigned cadres acting as consultants on population and family
planning subject to necessity.

It is also necessary to set up a specialized section
including full-time or part-time cadres who are competent of consulting matters
on population and family planning to the leaders in the following mass
organizations: The Central Committee of Women’s Union, The Youth Union's
Central Committee, The Central Committee of Peasants' Association, The
Vietnamese Confederation of Trade Union.

In the various offices and enterprises, the population and
family planning programmes should be incorporated into their agenda. Each of the
above-said unit must assign the population works to its key leader who in turn
will form a consultative body undertaking the population and family planning
activities in the unit.
Article 6:
-
Each province, city or special zone controlled by the
central government establishes its own population and family planning committee
(PCPFP) which is a subordinate organ of the people's committee and chaired by
the standing vice-chairman of the people's committee. A full-time vice -chairman
of the PCPFP together with a group of competent specialists on population and
family planning are responsible for assisting the PCPFP's chairman and
coordinating with the branches concerned in implementing the population and
family planning programme in their locality. The components of PCPFP's members
are similar to those of the PCPFP. Apart from the full-time cadres of the PCPFP,
whenever it is considered necessary, a number of cadres from PCPFP's member
branches will be mobilized to form a task-force in consulting, managing,
regulating and implementing the population and family planning programmes. The
PCPFP has its own seal, budget and office.

At the district and equivalent levels there is a
population and family planning department (PFPD) subordinating to the people's
committee of the district and headed by a vice-chairman of the people’s
committee’s of the district. The PFPD has 1 to 2 full-time cadres. Members of
PFPD are representatives of Health care, Education, Finance, Statistics,
Culture-Information branches and other mass organizations in the district.

At the communal and living-quarter level, the People's
Committee undertakes the population and family planning works with its
vice-chairman assigned for the implementation of this work together with a
task-force in the commune.
ARTICLE 7 :
THIS DECREE REPLACES THE DECISION
58/HDBT ADOPTED
ON 11 APRIL, 1984; DECISION 51/CT ADOPTED ON 6 MARCH, 1989 AND GOES INTO EFFECT
SINCE THE PROMULGATION DATE. OTHER PAST DECISIONS OR DECREES WHICH ARE CONTRARY
TO THIS DECREE ARE NULL AND VOID.
The NCPFP Chairman undertakes the full responsibility for
instructing, monitoring and inspecting the implementation of this Decree.
The Ministers, The Chairmen of the State Committees and the
heads of other offices under the Council of Ministers, The Chairmen of the
People’s Committees of Provinces, cities, special zone controlled by the
Central Government are responsible for carrying out this Decree.
