Problem overview:

     Framework for coordination: Environmental administration of governmental agencies have been realized as inefficient due to the fact that there are many agencies looking over environmental issues and the jurisdiction of power for each agency is unclear.

     Policies and measures: In the light of that realization, the Korean government has established an environmental institution know as Environmental Police/Inspector to alleviate the inefficacy and inefficiency of the system.

Background in summary:

     Administrative inefficiency and inefficacy of Korean environmental institutions: At present, the jurisdictions over environmental issues are dispersed among many agencies of central government and local governments. Consequently, present performance of local governments and central agencies regulatory activities are far from satisfactory. An environmental police system with strengthened organization and clearer jurisdiction, as being considered by the government. This would help improve the efficacy and efficiency of environmental administration greatly.

     Establishment of Environmental Police/Inspector to overcome jurisdiction problems: The Ministry of Environment considers to create a specialized regulatory body to effectively control the pollution. It is asked that a new full-fledged environmental police or environmental inspector system is needed to be created under MOE. The idea is to overcome the inefficiencies and potential biases of local governments and duplication/complication of jurisdiction among authorities. It is expected to eliminate duplication and complication related to environmental regulations.

Comments on this example:

     It should be noted that any economic instruments or market-based instruments need solid basis of effective monitoring and enforcement as their preconditions. ROKs environmental police/inspector system is only considered as one of the policy options. If it is adopted, it will deserve a special attention to be evaluated. I personally predict that, if adopted, will greatly improve the efficiency and efficacy, environmentally and economically as well, of environmental laws and regulations. The problem is whether it is politically feasible.

Sustainability of the project:

     Framework for coordination: Korea has taken a step to establish a central body to act as a coordinator and enforcer to assure that government administrative systems work efficiently because it has been experiencing the problem of inefficiency due to overlapping and/or absence of jurisdiction. It is necessary to have proper coordination framework when many stakeholders are involved.

Process of decision making and implementation:

     Policies and measures: It is a nationally accepted view that the enforcement is the most important issue in implementing environmental laws and regulations. In most cases, especially water quality regulation, illegal or inappropriate changes of land use are major source of the problem. Current system of regulation seems to not work well. Creation of environmental police/inspector would be a good solution. The potential problem is its cost side. If it reduces the cost of administration, it will be a great success.
