II. ENVIRONMENTAL IMPLICATIONS OF UNSUSTAINABLE DEVELOPMENT

I. Inadequacies of the legislative situation

The most important requirement is the activation of the Pakistan Environmental Protection Council which was officially created on 22 April 1990 when the names and positions of the council members were gazetted. Although the Ordinance requires the Pakistan Environmental Protection Council to meet at least twice a year, but unfortunately it has yet to be properly institutionalized.

It should be noted that the Pakistan Environmental Ordinance of 1983 and 1997 also implicitly allows the setting up of a Provincial Environmental Protection Council, which has, in fact, taken place in NWFP. Although the Provincial Environmental Protection Council is not yet active, the members have been nominated and its rules of business agreed upon.

A further provision in the Ordinance is the appointment of the Director-General of the Pakistan Environmental Protection Agency and EPA of NWFP for the proper implementation of EPO, 1997. The Agency, which is to be the professional and technical arm of the government, will play a significant part in preparing environmental policies. The appointments were made in June 1992.
