4. Nature of groundwater legislation

Groundwater legislation normally includes a provision for vesting the government with control of the resource. That control will include the right to:

  • Obtain knowledge of the status of development of the resource;
  • Protect the resource against contamination; Protect the resource against excessive withdrawal;
  • Penalize offenders who fail to abide by controls that are reasonably applied.

The legislation can be introduced either progressively or at once, depending upon the degree to which the community sees a need for controls.
