2. Relationships between the Shenyang Environmental Protection Bureau and relevant departments of the Shenyang municipal government

Environmental management covers a wide area, and includes the management of natural resources, the regional environment and the departments dealing with the environment. Many departments of the municipal government are responsible for environmental issues. Among them, the Urban and Rural Construction Committee and the Planning Committee play a crucial role in formulating and implementing environmental policies. The Environmental Protection Bureau and the Health Bureau are the most important administrative departments related to environmental matters.
  1. Shenyang Health Bureau
  2. The Shenyang Health Bureau includes the General Office, the Science Technology and Education Section, the Sanitation and Epidemic Prevention Section, the Women and Children Sanitation Section, the Sanitation Supervision Section and the Policy Research Room. The Health Bureau is responsible for public sanitation and health.

  3. Coordination and integration between the Shenyang Planning Commission and Shenyang Environmental Protection Bureau
    1. Coordination
    2. One example of coordination between the Shenyang Planning Commission, the Shenyang Environmental Protection Bureau and other municipal departments is the preparation of a joint environmental protection strategy which is inter-institutional and cross-sectoral.

    3. Integration
    4. When the Municipal Planning Commission drafts its development plan, it includes the goals, plans, indexes and projects of the environmental plan formulated by the Shenyang Environmental Protection Bureau in the national economy development plan. The Commission makes a careful balance between funds, technology, projects and environmental planning. After capital construction projects planned by the Shenyang Environmental Protection Bureau are integrated into the national economic development plan they can then be implemented.

    5. Municipal Environmental Protection Committee
    6. The Municipal Environmental Protection Committee is a permanent coordinating committee. Its tasks are to examine the environmental planning of the city through consultations, communicate the policies, objectives and plans of the different departments, resolve major environmental questions facing the city and coordinate relationships between the different departments and professions with regard to solving environmental problems. The vice-mayor in charge of the environment is the director of the Environmental Protection Committee, while the vice-director of the Committee is the director of the Shenyang Environmental Protection Bureau. Leaders of the municipal Planning Commission, Sciences and Technology Commission, Building Commission, Economic and Trade Commission are leading members of Municipal Environmental Protection Committee. Member units of the Municipal Environmental Protection Committee comprise more than 50 relevant departments of the municipal government, with representatives from each department responsible for environmental activities. The administrative office of the Municipal Environmental Protection Committee is located in the Shenyang Environmental Protection Bureau. The main function of the Municipal Environmental Protection Committee is to make key decisions on environmental protection for the whole Shenyang area.

      The Environmental Protection Bureau and the Health Bureau provide the Committee with current information about the environmental situation. The Planning Committee and the Construction Committee provide information about the implementation and planning of projects. The Environmental Protection Bureau analyses the environmental situation in Shenyang, both in terms of the short-term and long-term goals. Related environmental policies are formulated in that way and are transmitted to the responsible departments for implementation.

    7. Coordination and cooperation of environmental management between the Shenyang Environment Protection Bureau and other relevant departments
    8. The other departments of the municipal government exercise authority over environmental protection where it relates to their individual functions. The performing basis is the Environmental Protection Law, and other regulations concerning environmental protection. The legal coordinating and cooperating mechanisms of environmental management have been established. The legal coordinating and cooperating mechanisms between the Shenyang Environment Protection Bureau and other departments concerned are clearly laid down in the laws and regulations:

      • According to clause 7 of the Environmental Protection Law, "administrative departments, at all levels, of public security, traffic, railways and civil aviation administration supervise and manage the prevention and control of environmental pollution on the basis of relative law provisions. The administrative departments of land, minerals, forestry, agriculture and water resources in governments above county level carry out supervisory management of resource protection on the basis of relative law rovisions";
      • According to Article 4, Clause 3, of the Law on Prevention and Control of Water Pollution, "administrative departments, at all levels, of water resources, sanitation and health administration, geology, minerals, municipal administration and institutions of protecting major rivers carry out supervisory management of prevention and control of ater pollution, cooperating with environmental protection departments, in the light of heir own responsibility";
      • In accordance with Clause 3, Section 2, of the law on Prevention and Control of Atmosphere Pollution, "the administrative departments of public security, traffic, railways and fishery administration, in the light of their own responsibility, carry out upervisory management of motor vehicles and ships that pollute the atmosphere";
      • According to Clause 6 of the Regulations on Prevention and Control of Environmental Noise Pollution, "administrative departments, at all levels, of public security, traffic, railways and civil aviation administration, in the light of their own responsibility, undertake supervisory management of environmental noise pollution from motor vehicles, trains, ships and aircraft. Departments of public security at all levels arry out supervisory management of social living noise pollution".
